KayaPoint provides a digital logistics platform offering freight forwarding coordination, shipment tracking, rate quotation, and related logistics management tools. Our Services connect clients with freight carriers for air and ocean freight. KayaPoint acts as a logistics intermediary and is not itself a carrier.
3. User Accounts
To access certain features, you must register for an account. You agree to provide accurate, complete, and up-to-date information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Use of the Platform
You agree to use the platform solely for lawful business purposes. You must not misuse the platform by knowingly introducing malicious code, attempting unauthorized access, or using the Services for any illegal or fraudulent activity. You are responsible for ensuring all shipment information submitted is accurate and compliant with applicable laws and regulations.
5. Shipments and Liability
KayaPoint facilitates the arrangement of freight transport but does not take physical custody of goods. Liability for loss, damage, or delay of goods is governed by the applicable carrier's terms and international conventions. Customers are advised to obtain adequate cargo insurance. KayaPoint's liability is limited to the fees paid for the relevant service.
6. Payment and Fees
Fees for Services are as quoted and agreed upon prior to shipment. All invoices are due within the payment period specified. Late payments may incur interest charges. KayaPoint reserves the right to suspend Services for accounts with outstanding balances. Quoted rates are subject to carrier surcharges and may be adjusted accordingly.
7. Intellectual Property
All content, trademarks, logos, and software on the KayaPoint platform are the property of KayaPoint or its licensors. You may not reproduce, distribute, or create derivative works without our express written consent. You are granted a limited, non-exclusive license to use the platform solely for your legitimate business purposes.
8. Privacy and Data Protection
KayaPoint collects and processes personal data in accordance with applicable data protection laws. We collect information necessary to provide our Services, including name, email, phone number, company details, and shipment data. We do not sell your personal data to third parties. Data is shared only with carriers and service providers necessary to fulfill your shipments. You may request access to, correction of, or deletion of your personal data by contacting us.
9. Cookies
Our platform uses cookies and similar tracking technologies to improve your experience, analyze usage, and maintain session authentication. You may control cookie preferences through your browser settings. Disabling cookies may limit certain functionality of the platform.
10. Limitation of Liability
To the maximum extent permitted by law, KayaPoint shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total aggregate liability shall not exceed the fees paid by you in the three months preceding the event giving rise to the claim.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which KayaPoint is registered, without regard to conflict of law provisions. Any disputes shall be subject to the exclusive jurisdiction of the competent courts of that jurisdiction.

KayaPoint reserves the right to modify these Terms at any time. We will notify registered users of material changes via email or platform notification. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
